This Privacy Notice (“Privacy Notice”) describes how FreshEdge and our family of companies (“FreshEdge,” “we,” “our” or “us”) may collect, use and disclose the Personal Information we collect from you or about you in the context of your relationship with us; the choices you have regarding our use of your Personal Information; and how to contact us regarding our privacy practices. As used in this Privacy Notice, “Personal Information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household.
This Privacy Notice applies to the Personal Information we collect from you, or about you, including when you: visit and interact with any of our websites that link to this Privacy Notice (the “Websites”); order our products or services; download or otherwise engage with a product catalogue, weekly market review, recipe, or other materials we publish; provide a review or testimony regarding our products and services; or otherwise provide Personal Information to us, either online or offline. We maintain a separate privacy notice for job applicants and employees.

Personal Information We Collect
We may collect your Personal Information directly from you, automatically through our Websites or from third parties. The categories of Personal Information we collect depends on your interactions and engagement with us.
Personal Information We Collect Directly From You
We may collect Personal Information directly from you when you interact with us, such as when you order a product or service or contact us regarding our products or Websites. We may collect the following Personal Information directly from you:
- • Identifiers, such as your name, address, email address, phone number, social media handles, and other similar information. We use this information to provide our products and services and to otherwise communicate with you.
- • Information Subject to Protection by State Law including payment card, debit card or bank account numbers, which our service providers may collect.
- • Commercial Information, such as the products and services you purchase or receive from us and information you provide in connection with your order.
- • Professional Information, including information relating to your role as a representative or agent of a company or business, such as your work title and contact information. We use this to conduct business with you or your employer and provide you with services and otherwise communicate with you.
- • Sensitive Personal Information. Our service providers may collect your billing information and credit and/or debit card number. We only use sensitive personal information for purposes permitted by applicable law
Personal Information We Collect Automatically
We may automatically collect Personal Information about you when you access or use our Websites.
- • Internet Activity Information: This includes the pages you view, the time of your access, and how long you use the Websites. We also collect information about the computer, tablet, smartphone or other electronic device you use to connect to our Websites.
- • Log Information: Log information is data about your use of the Websites that may be stored in log files. We use this information to understand how users interact with our Websites.
- • Non-specific Geolocation Data: We collect this information to provide you with our products and services and to better tailor our services to you depending on your geographical region.
- • Cookies: When you visit or use our Websites, our server may create cookies, which are small text files that a website can send to your internet browser and may be stored in your browser or elsewhere on your computer. We use cookies and other similar technologies on our Websites. We use cookies to evaluate website usage and to offer programs and/or services that you may be interested in.
- o Google Analytics: Our Websites use Google Analytics to help us analyze how users use the Websites and target users with appropriate advertisements. The information generated by the cookie about your use of the Websites (including your IP address) will be transmitted to and stored by Google. Read about Google’s privacy practices.
- o You may disable our usage of cookies through your browser settings. Please note that if you disable your browser’s ability to accept cookies, you will be able to navigate our Websites, but you will not be able to take advantage of certain features. In addition, you can opt out of non-essential cookies, by using our consent management tool.
Personal Information We Collect from Others
We may obtain Personal Information about you from other sources, including our customers. This may include your name, email address, and additional contact information. We use this information to deliver products or services to you or to otherwise interact with you.
How We Use Your Personal Information
We use your Personal Information to:
- • Provide Our Products and Services: We use your Personal Information to provide our products and services, create and administer user accounts, and communicate with you in relation to providing you products and services.
- • Build and Maintain Our Relationship With You: We use your Personal Information to improve your experience on our Websites and provide you with customer service.
- • Improve our Websites and Services: In order to improve your experience and provide you with products and services, we use your Personal Information to analyze how our Websites are being accessed and used, improve the functionality and develop new product and service offerings.
- • Maintain the Security of Our Websites: We use your Personal Information to maintain the security and integrity of our Websites, we use your Personal Information to detect security incidents, protect our Websites against fraudulent and illegal activity and enforce our terms of use.
- • Send Marketing Communications: We use your Personal Information to send you marketing information, product recommendations and other non-transactional communications (e.g., marketing newsletters) about us. This may include information about our products, services, or promotions.
- • Comply with Our Legal Obligations and Respond to Legal Proceedings: We use your Personal Information to comply with legal, reporting, and similar requirements; investigate and respond to claims against us, our personnel, and our customers; for the establishment, exercise or defense of legal claims; protecting our, your, our customers’, and other third parties’ safety, property or rights; detecting, preventing, and responding to security incidents; and to protect against malicious, deceptive, fraudulent, or illegal activity.
How We Disclose Your Personal Information
We may disclose your Personal Information in the following circumstances:
- • With service providers that perform business tasks on our behalf, such as payment processing, website and customer experience hosting, data analysis, data storage, auditing and accounting providers.
- • With our corporate affiliates that perform administrative, billing, fulfillment, and similar tasks on behalf of our brands.
- • With advertising partners that help us display digital ads and track conversions.
- • If we believe such disclosure is necessary. For example: to comply with relevant laws or to respond to a subpoena, warrant or court order served on us; to respond to valid requests by government agencies, including law enforcement authorities; if we believe your actions are inconsistent with our terms of use, user agreements, applicable terms or policies; to protect against fraud and for risk management purposes; to protect the rights, property, life, health, security or safety of FreshEdge, its Websites, employees, customers, Websites users and any third party; or for the establishment of defenses or claims in any legal action or dispute involving FreshEdge or any of its officers, directors, employees, agents, contractors and partners.
- • In the event we sell, transfer or assign all or a portion of our business or assets (e.g., further to a sale, merger, consolidation, change of control, reorganization, liquidation or any other business transaction, including negotiations of such transactions), we reserve the right to disclose any Personal Information we collect through our Websites or offline.
- • To other third parties, with your consent.
Your Choices
Unsubscribe from Marketing Emails
If you no longer wish to receive marketing emails, you may unsubscribe at any time by clicking the “unsubscribe” link in the emails sent to you or by contacting us using the information below under “Contact Us.” Please note that if you opt out of receiving marketing-related emails from FreshEdge, we may still send you messages about your orders or other administrative messages.
Opt-Out of Tracking Technologies and Global Privacy Control
Web browsers and other technologies you may use to access websites may include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. Given the divergent practices of organizations that offer browsers and the lack of a standard in the marketplace, we generally do not respond to do-not-track signals at this time. We recognize Global Privacy Control (“GPC”) signals.
Third Parties
Our Websites, products, and other materials may contain references and/or links to third-party websites and services, including references and links to third parties that accept and process your payments to us. We are not responsible for any third party’s data collection or privacy practices, and we have no control over what information third parties track or collect. Any access to and use of such linked websites is not governed by this Privacy Notice but instead is governed by the privacy policies of those third-party websites. We encourage you to review the privacy policies posted on those third-party websites for further information.
Data Retention and Security
We will store your Personal Information for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the information was collected, or as may be permitted under applicable law. We maintain technical and organizational measures to protect your Personal Information against loss, theft, misuse, and unauthorized access, disclosure, alteration and destruction. However, transmission via the Internet and online digital storage are not completely secure and we cannot guarantee the security of your Personal Information.
Children’s Privacy
Our Websites, products, and services are intended for individuals age 18 and over. We do not knowingly collect Personal Information through our Websites from individuals under the age of 18. If we learn we have collected or received Personal Information from a child under 18, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us at privacy@freshedgefoods.com.
International Users
If you are visiting our Websites from outside the United States, please be aware that FreshEdge is based in the United States and the information we collect will be transferred to, processed and stored on our servers in the United States in accordance with this Privacy Notice and applicable laws. The data protection laws and regulations applicable to your Personal Information transferred to the United States may be different from the laws in your country of residence.

California Disclosures
These Additional California Privacy Disclosures supplement the information contained in the Notice above. These Disclosures apply only to individuals residing in California.
We collect the categories of Personal Information and from the sources described in the “Personal Information We Collect” section of this Notice.
We may use and disclose Personal Information for the business and commercial purposes detailed in the “How We Use Your Personal Information” section of this Notice.
We may disclose your Personal Information to the categories of third parties described in the “How We Disclose Your Personal Information” section of this Notice.
We retain your information as described in the “Data Retention and Security” section of this Notice.
Sale or Sharing of personal information: We do not sell personal information for monetary consideration. However, our use of certain tracking-technologies may meet the definition of “selling” or “sharing” as that term is defined by applicable law. We may have sold or shared the following categories of personal information with our targeted advertising service providers and partners: Identifiers and Internet Activity Information. We do not knowingly sell the personal information of minors under 16.
In addition to the rights and choices outlined above, you may also request to exercise the following privacy rights:
- • Right to know: The right to request to know what Personal Information we collected about you (categories and specific data elements), from where we collected it, why we have collected, sold, or shared it, and to whom we have disclosed it.
- • Right to delete: The right to request that we delete Personal Information we collected from you.
- • Right to correct: The right to correct inaccurate Personal Information we maintain about you.
- • Right to opt out: The right to opt out of certain automated processing and profiling activities, as well as the sale and sharing of your Personal Information for targeted advertising purposes. We do not currently engage in practices involving automated decision-making, profiling, or selling Personal Information other than as disclosed in this Privacy Notice.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits California residents to request and obtain from us, once a year and free of charge, information about categories of Personal Information (if any) we disclosed to third parties for those third parties’ direct marketing purposes and the names and addresses of all third parties to whom we disclosed Personal Information in the immediately preceding calendar year. You may opt out of these disclosures by writing us at privacy@freshedgefoods.com.
Other U.S. State Disclosures
Residents of Nebraska and Texas may also request to exercise the following privacy rights (subject to any applicable exemptions and limitations):
- • Right to access: You have the right to confirm whether we are processing your Personal Information and to access such Personal Information.
- • Right to correct: You have the right to request that we correct inaccurate Personal Information that we maintain about you.
- • Right to delete: You have the right to request that we delete your Personal Information under specific circumstances.
- • Right to opt-out: You have the right to object or opt out of certain types of processing, including: (1) processing for the purpose of targeted advertising, (2) processing for the purpose of the sale of Personal Information, and (3) processing for the purpose of certain types of profiling and automated decision-making. We do not currently engage in practices involving automated processing, profiling, or selling Personal Information other than disclosed in this Privacy Notice.
- • Right to data portability: You have the right to request a copy of your Personal Information in an accessible format.
- • Right to appeal: If we do not grant your consumer request, you may have the right to appeal that denial.
Exercising Your Rights
If you are a resident of California, Texas or Nebraska, to exercise any of the above rights, please submit a request to us by emailing us at privacy@freshedgefoods.com or calling us at 1800-377-2425. Making a consumer request does not require you to create an account with us. If exercise any of your privacy rights, we will not discriminate or retaliate against you. Applicable law may limit the number of times that you can submit a particular request within a 12-month period.
You may be able to designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf or if the agent attempts to exercise a right for which they are not legally authorized to do so.
Upon receiving your request to know, access, delete, or correct, we will need to verify your identity to determine that you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. We may also use other verification methods as the circumstances dictate. We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We may deny your request to know, access, delete, or correct if we cannot verify your identity.

We may occasionally update this Privacy Notice to reflect changes in our practices. When we post modifications to this Privacy Notice, we will revise the “Effective Date” at the top of this Privacy Notice. If the changes are material, we will endeavor to notify you in advance of such changes taking place to the extent required by law.
